Driver sentenced to 93 days in jail after killing 3-year-old in crash

Father: "I don't think justice was served."

SHELBY, Mich. — Baily Conaway is the driver who killed 3-year-old Alaya Melchor in a crash March 2019. The crash also put Alaya's brother and sister in the hospital.

In Newago District Court Wednesday, Conaway was sentenced to 93 days in jail with work release and a year's probation for five misdemeanor charges connected to the crash.

Alaya's dad Casey, the passenger in the car the day of the crash, says this is not justice for his little girl. Casey was not in the car that caused the crash. Their vehicle was t-boned.

“In my eyes, that’s nothing. I lost my daughter. My son will have to be evaluated every year for the rest of his life for his head injuries. My daughter wakes up at night with sweats and screaming and she misses her sister. She thinks we’re still in the accident.” Casey Melchor said.

Court documents given to FOX 17 by family and family's attorneys show the brakes in Conaway's car were rusted and in disrepair.

Conaway says in the documents the brakes did not work the day of the crash, which is why he ran the stop sign at Elm and Baseline where the crash occurred.

Prior to the crash, Conaway says in the documents the brakes had been working fine.

Alaya's family says that car should have never been on the road.

“We’re hoping for this one little justice. We felt like we got slapped in the face today,” Melchor said.
