The Kent County counselor accused of having more than 42,000 images of child porn on his computer and distributing a manifesto on how to molest children is back out on bond.

He appeared before a federal court judge Tuesday.

The US Attorney’s Office wanted the judge to detain him again following new allegations that surfaced regarding his behavior towards minors.

They said a teen had come forward saying Marchione had molested him two or three years ago while the two were home alone.

A special agent also testified to other allegations.

He told the court that Marchione had been caught a number of years ago walking to a backyard garage area with a young man in the middle of the night,  holding his hand.

There were no police reports on file regarding that incident.

The judge weighed the new information Tuesday before deciding that the government’s request to detain Marchione would be denied.

He said attorneys should have requested that Marchione be detained during a previous hearing and without new and different charges, he should remain out on bond.

However, the judge did tighten those bond restrictions.

He said, “I’m not naive. I see the defendant has surrounded himself with children all of his life.  Either he`s Mother Theresa or he has an unhealthy interest in children.”

The judge said Marchione is now prohibited from any contact with minors and the family must terminate their Internet service at their house.

Marchione must also remain under house detention which means he cannot leave the home in Alto without giving court officers an approved schedule.

The judge indicated he must also be monitored by GPS.
