Baby Kate Trial – Officer testifies finding clothing in Phillips’ pocket

LUDINGTON, Mich. - The trial continues this week for a man accused of killing his four month old baby.

Sean Phillips is on trial for killing "Baby Kate" five years ago.  Her body has never been found.  Phillips is currently serving a ten year sentence for kidnapping the baby.

Starting on the stand Monday was the Ludington police officer Tony Custer who interacted with Phillips and his mother, Kim Phillips on the day Kate was first reported missing.

Custer testified that Phillips first told him that Kate was with her mother Ariel Courtland.  Custer then told Phillips, "I know you're not telling the truth."  Phillips replied with, "You're right. I'm not telling the whole truth."

The officer testified that he saw something bulging from Phillips' pocket.  It turned out to be Baby Kate's clothing. Later, officers found Baby Kate's car seat and the case went from being a well-being check to a missing persons case.
