LUDINGTON, Mich. -- A Mason County Circuit Court judge ruled Friday that prosecutors can charge Sean Phillips with open murder in the case of his daughter, Kate.
This decision is a reversal of a district court judge's September ruling that there was not enough evidence to send Phillips to trial.
Phillips is currently serving a 10-15 year prison sentence after being convicted of unlawful imprisonment for taking Kate from her mother in the summer of 2011. Baby Kate has never been found.
“We have evidence that we are convinced will prove beyond a reasonable doubt that Sean Phillips murdered his own daughter,” Michigan Attorney General Bill Schuette said in October 2013.
