MASON COUNTY, Mich. – The father of the 4-month-old who went missing 2 years ago filed to appeal his conviction Friday.
Sean Phillips was convicted of unlawful imprisonment in Mason County. He was sentenced to 10 years in prison.
His daughter, Baby Kate, went missing in June of 2011.
Despite months of searching, she has never been found.
The lawyer said in the appeal that the judges sentencing recommendations weren’t articulated as substantial or compelling.
Police have called this a homicide case.
Phillips has not been charged with murder.
