The accused killer of 2-year-old Jozlynn Martinez was back in court Wednesday and for now it looks like his case is headed to trial.

The only offer from prosecutors was for Jeffrey Malmberg to plead as charged, an option he declined.

That means the case is ready to be scheduled for trial; no date has been set. Malmberg is accused on kneeling on the toddler's chest until she stopped breathing, then disposing of her body in the dumpster.

Martinez is the daughter of Malmberg's live-in girlfriend. The defense has said they could be filing motions soon, including one to possibly have Malmberg's confession thrown out.
